Richard G. (Chip) Sander
Shareholder
Mr. Sander has over 24 years experience in complex commercial litigation and business matters. He has extensive experience in dealer program matters, construction lending and copyright. Mr. Sander also has significant experience with all types of business litigation, including employment litigation and litigation of contract disputes, securities matters, class actions, lender liability, intellectual property and real estate.
Mr. Sander has appeared in cases pending in federal courts in Utah, Iowa, Arizona, California, Massachusetts and Colorado and argued cases before the Ninth, Tenth and Federal Circuit Courts of Appeal and the Colorado Supreme Court. In addition, Mr. Sander has tried cases in state district courts in many jurisdictions throughout Colorado and in Arizona and Utah.
Mr. Sander graduated from the University of California at Berkeley, with high honors, in 1978 and from the University of Colorado School of Law in 1982 and has practiced in Denver, Colorado since that time. In addition to being a member of the Colorado State Bar, Mr. Sander has been admitted to practice law in the United States District Court of the District of Colorado, the Ninth Circuit, the Tenth Circuit, the Federal Circuit and the United States Supreme Court. Mr. Sander’s practice has focused exclusively on commercial and business matters.
Honors and Awards
Mr. Sander is a Fellow in the Litigation Counsel of America, an invitation only society comprised of less than one-half of one percent of American trial lawyers and he was elected by peers in 2007, 2008 and 2009 as a “Super Lawyer” (awarded to top 5 percent of the Colorado Bar). Mr. Sander has received an AV peer review rating from Martindale Hubbell © (highest rating for legal ability and ethical standards).
Construction Lending Matters
Mr. Sander has represented construction lenders for over a decade and is a founding member and director of the National Association of Residential Construction Lenders. Mr. Sander has provided counsel to lenders regarding (i) borrower defaults under construction loan agreements; (ii) issue resolution when borrower defaults are the result of borrower-general contractor disputes; (iii) litigation arising from construction loan agreements; (iv) drafting of construction loan agreements and related documents; (v) claims arising from lender inspections; and (iv) other construction lending based claims.
Dealer/Licensee Matters
Mr. Sander has represented national dealer programs since 1993, focusing on the security/alarm industry. In his capacity as outside counsel, Mr. Sander has assisted his clients with dealer programs in (i) drafting and revising dealer agreements; (ii) dealer terminations; and (ii) dealer litigation. Similarly, Mr. Sander has represented licensors in disputes with licensees and in drafting and revising license agreements.
Intellectual Property Matters
Mr. Sander has represented specialty clothing designers in Copyright Act and Lanham Act claims for over a decade and has successfully vindicated the rights of copyright holders when their designs have been “knocked off” by competitors.
